Terms of Use

Effective 8 September 2026. These terms govern your use of Elyum (elyum.ai), operated by Elyum AI, Inc. (“Elyum”, “we”). By creating an account or using the service you agree to them and acknowledge our Privacy Policy. If you use Elyum for a business, you accept these terms on its behalf.

1. The service

Elyum is an AI creative studio: it generates images, videos, talking avatars and creator-fronted clips using third-party AI models, in single takes or batches, and provides tools to review (keep or kill), export and integrate that output through the web app, the API, MCP and the agent.

2. Accounts

You must be at least 18 and provide accurate information. You are responsible for activity under your account and for keeping your credentials and API keys secret. One person or business per account; workspaces are personal today. Tell us at [email protected] if you suspect unauthorised use.

3. Credits, plans and payment

Usage is metered in credits. Credits are held when a render starts and charged only when you keep an output (“pay only for what you keep”); killed, failed and expired renders are released or refunded automatically. Plans include a number of kills per billing period (shown in the app beside your credits); letting a preview expire undecided uses one like a kill, and when a plan’s kills are used up, further kills may be refused until the period resets. Credits have no cash value, are non-transferable and are non-refundable except where the law requires. Plans grant credits for the paid period; unused plan credits do not roll over unless a plan says so. Memberships may be granted by code (coupon) for a fixed period; when a paid period ends without renewal the workspace returns to the Free plan. Prices are shown before you pay and exclude taxes we are required to collect. We may change prices, plan limits, credit costs and which features consume credits; we post changes on the site, and a price change to a plan you already pay for applies from your next billing period.

4. Promotional credits and programs

Welcome credits, referral and partner rewards, Earn campaign payments, coupons and any other promotional credits or offers are granted at our discretion. They may carry conditions and expiry dates stated when they are granted, have no cash value, and are not transferable or refundable. Published rates for the referral, affiliate, Creator Partner and Earn programs are maximums (“up to”); the programs are governed by the Partner Terms and the Earn Campaign Rules, and we may change, limit, suspend or end any promotion or program at any time, as those documents describe. We may withhold or reverse promotional credits obtained through fraud, abuse or a breach of these terms.

5. Free plan and previews

Locked previews (before you keep an output) are reduced-quality, watermarked and licensed for evaluation only; you may not remove or obscure preview marks or use previews commercially. Kept outputs are delivered clean on every plan, Free included. Free-plan features, limits and availability may change, and we may pause free generation while we manage capacity.

6. Your content

You keep all rights to what you upload (photos, reference images and clips, creator photos, briefs) and to your prompts. So that we can run the service, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt (for example transcode, resize or watermark), process and transmit your content, including to the AI model providers and other service providers we use, for the purposes of operating, providing, securing and improving the service, as described in the Privacy Policy. This licence ends when you delete the content or your account, except for copies in routine backups for a limited period, information that has been aggregated or de-identified so that it no longer identifies you or your content, and retention the law requires. We do not sell your content and we do not use it to advertise to others. You can ask us not to use your workspace’s content to improve the service at any time (Privacy Policy, section 8).

You represent that you have the rights and consents needed for everything you upload, including from any real person whose face or voice appears in it, and that your inputs and the content you make with them comply with the law and with the rules of the platforms where you publish.

7. Output you keep

Subject to these terms and to the extent we are able, we assign to you our rights in outputs you have kept (paid for), and you may use them commercially. AI outputs may not be protectable by copyright everywhere, and similar outputs may be produced for others. House creators are synthetic; you may use them in content made with Elyum but may not present them as real people or endorsements.

8. AI output: no guarantees

Outputs are machine-generated and can be inaccurate, off-brief or unsuitable. You are responsible for reviewing outputs before use, for the claims your content makes, and for compliance with advertising, consumer-protection, privacy, publicity and platform rules wherever you publish. Elyum does not verify factual claims in generated scripts, and outputs are not professional advice.

9. Acceptable use

Do not use Elyum to make content that is unlawful, defamatory, deceptive, infringing, sexually explicit, hateful, or that impersonates a real person without consent; to make deepfakes of real people; to circumvent metering, previews, watermarks or rate limits; to scrape, resell or share access to the service; or to attack the service or its providers. Requests pass through our providers’ safety systems and may be reviewed by automated tools and, where flagged, by our staff. We may refuse, remove or report content and may suspend accounts that break these rules.

10. API, keys, agents and limits

API keys and OAuth grants act as you and are subject to these terms. Scopes and daily caps you set are limits, not guarantees; you remain responsible for what a connected agent does with your credits. We may set and change rate limits, concurrency and other usage limits, and may use technical measures such as queuing or throttling to enforce them.

11. Third-party models and services

Outputs are produced by third-party AI models, and the service relies on third-party hosting, payment, support and analytics providers. We choose and route between providers and may add, replace or retire models at any time. Model providers’ own usage policies apply to the inputs sent to them; where a provider rejects a request, the render fails and the held credits are released.

12. Availability and changes

The service is provided “as is” and “as available”. We may change, suspend or discontinue features, models, plans or the service itself. Where a change materially reduces what a paid plan offers, we aim to give notice on the site or by email before it takes effect.

13. Intellectual property complaints

If you believe content on Elyum infringes your rights, email [email protected] with the URL, a description of the work, your contact details and a good-faith statement that the use is unauthorised. We remove or disable content that infringes and may close the accounts of repeat infringers.

14. Suspension and termination

You can delete your account at any time from /account; this removes your workspace, history and unused credits. We may suspend or terminate accounts for breach, non-payment, fraud, abuse, risk to the service or legal reasons. Sections 3, 4, 6 to 9 and 15 to 20 survive termination.

15. Disclaimer of warranties

To the maximum extent permitted by law, Elyum and its providers disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and any warranty that the service or its outputs will be accurate, original, uninterrupted or error-free. You use the service and its outputs at your own risk.

16. Limitation of liability

To the maximum extent permitted by law, Elyum is not liable for indirect, incidental, special, punitive or consequential loss, lost profits, lost revenue or lost data, and our total liability for all claims relating to the service is limited to the amount you paid us in the 12 months before the claim (or 100 USD if you paid nothing). Nothing here limits liability that cannot be limited by law, and consumers keep the rights their local law grants them.

17. Indemnity

If you use Elyum for a business, you will defend and indemnify Elyum and its officers, employees and providers against claims, damages and reasonable costs arising from your content, the outputs you publish, your use of the service or your breach of these terms. If you are a consumer, this section applies only to the extent your local law allows.

18. Privacy

Our Privacy Policy explains what we collect, why, who receives it and how long we keep it.

19. Changes to these terms

We may update these terms. We post the new version here and update the effective date; for material changes we also notify you in the app or by email where practical. Changes take effect when posted unless they state a later date, and continued use after that means you accept them. If you do not agree, stop using the service and delete your account.

20. General

These terms are governed by the laws of the State of Delaware, United States, and disputes go to the courts there unless mandatory consumer law says otherwise. If a clause is unenforceable the rest stands. You may not assign these terms; we may assign them to a successor of our business. Neither side is liable for delay caused by events outside its reasonable control. Our not enforcing a clause is not a waiver of it. You must comply with export-control and sanctions laws when using the service. These terms, the Privacy Policy and, where they apply, the Partner Terms and Earn Campaign Rules are the whole agreement between us about the service. Questions: [email protected].
