Terms of Service
Effective 17 August 2026. These terms govern your use of Elyum (elyum.ai), operated by Elyum (company registration pending) (“Elyum”, “we”). By creating an account or using the service you agree to them.
1. The service
Elyum generates advertising creative — images, short videos, creator-fronted clips, talking avatars and multi-ad “test packs” — using third-party AI models, and provides tools to review, keep, export and integrate that output (web app, API, MCP).
2. Accounts
You must be at least 18 and provide accurate information. You are responsible for activity under your account and for keeping credentials and API keys secret. One person or business per account; workspaces are personal today. Tell us at [email protected] if you suspect unauthorised use.
3. Credits, plans and payment
Usage is metered in credits. Credits are held when a render starts and charged only when you keep an output (“pay only for what you keep”); killed, failed and expired renders are released or refunded automatically. Credits have no cash value, are non-transferable, and are not refundable except where the law requires. Plans grant monthly credits for the paid period; unused plan credits do not roll over unless a plan says so. Memberships may be granted by code (coupon) for a fixed period; when a paid period ends without renewal the workspace returns to the Free plan. Prices, plan limits and credit costs may change with notice on the site; changes apply from the next period.
4. Free plan and previews
Free-plan output may carry a visible watermark. Locked previews (before you keep an output) are reduced-quality, watermarked, and licensed for evaluation only — you may not remove or obscure preview marks or use previews commercially.
5. Your content
You keep all rights to what you upload (product photos, reference clips, creator photos, briefs). You grant us a licence to store, process and transmit it to the AI providers we use, solely to provide the service. You represent that you have the rights and consents needed — including from any real person whose face or voice appears in material you upload — and that your inputs and the ads you make with them comply with law and platform rules.
6. Output you keep
Subject to these terms and to the extent we are able, we assign to you our rights in outputs you have kept (paid for). AI outputs may not be protectable by copyright everywhere and similar outputs may be produced for others. House creators are synthetic; you may use them in ads made with Elyum but may not present them as real people or endorsements.
7. AI output — no guarantees
Outputs are machine-generated and can be inaccurate, off-brief or unsuitable. You are responsible for reviewing outputs before use, for the claims your ads make, and for compliance with advertising, consumer-protection, privacy and platform rules. Elyum does not verify factual claims in generated scripts.
8. Acceptable use
Do not use Elyum to make content that is unlawful, defamatory, deceptive, infringing, sexually explicit, hateful, or that impersonates a real person without consent; to make deepfakes of real people; to circumvent metering, previews, watermarks or rate limits; to scrape or resell the service; or to attack the service or its providers. We may refuse, remove or report content and suspend accounts that break these rules.
9. API, keys and agents
API keys and OAuth grants act as you and are subject to these terms. Scopes and daily caps you set are limits, not guarantees; you remain responsible for what a connected agent does with your credits.
10. Availability and changes
The service depends on third-party models and hosting and is provided “as is” and “as available”. We may change, suspend or discontinue features, and may retire or replace models. We aim to give notice of material changes on the site.
11. Termination
You can delete your account at any time from /account; this removes your workspace, history and unused credits. We may suspend or terminate accounts for breach, non-payment, abuse or legal reasons. Sections 3, 5–8, 12–14 survive termination.
12. Liability
To the maximum extent permitted by law, Elyum is not liable for indirect, incidental, special or consequential loss, lost profits or lost data, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim (or 100 USD if you paid nothing). Nothing here limits liability that cannot be limited by law.

14. General
These terms are governed by the laws of England and Wales, and disputes go to the courts there unless mandatory consumer law says otherwise. If a clause is unenforceable the rest stands. These terms are the whole agreement between us about the service. We may update them; continued use after a change means you accept it. Questions: [email protected].
